<p>GRETNA – A Jefferson Parish man is suing a local gas station for injuries he alleges he received when he slipped on a patch of oil on the pavement.</p>
<p>Marvin Gordon filed suit against Spur Gas Station and their insurer in the 24th Judicial District Court on April 23.</p>
<p>Gordon claims he was at the Spur Gas Station located at 3220 Jefferson Hwy. in Jefferson when he stepped in an oily substance and fell to the pavement as he attempted to get gas. The plaintiff alleges he received serious bodily injuries in the incident</p>
<p>The defendant is accused of failing to see what should have been seen, failing to maintain proper condition on the premises and failing to maintain a proper lookout.</p>
<p>An unspecified amount is sought for damages.</p>
<p>Gordon is represented by Tony Dooley of the New Orleans-based Dooley Law Office LLC.</p>
<p>The case has been assigned to Division E Judge John J. Molaison Jr.</p>

<p>Tommie Johnson filed suit against Keidra Phillips-Burrel, Roy Burrell and Krescent City Kids LLC in the 24th Judicial District Court on April 23.</p>
<p>Johnson claims he was contracted to provide renovation of the Krescent City Kids daycare facility located at 329 Dorgenois St. in New Orleans. The plaintiff alleges the even though Phillips-Burrell repeatedly paid him via checks those checks cold not be cashed later and the defendants ultimately failed to make payments that met the terms of the contract. Johnson asserts he is still owed for the full amount of the renovations.</p>
<p>An unspecified amount in damages is sought for monetary damages.</p>
<p>Johnson is represented by attorney Eugene P. Redmann of Metairie.</p>
<p>The case has been assigned to Division M Judge Henry G. Sullivan Jr.</p>

<p>Walter J. Breaux, individually on behalf of Walter J. Breaux Electrical Services, filed suit against the Olympic Group LL and the Gray Insurance Company in the 24th Judicial District Court on April 23.</p>
<p>Breaux claims his company Walter J. Breaux Electrical Services was subcontracted by the Olympic Group to provide labor, tools, equipment and materials in the renovation of the Woodlake School in Mandeville.</p>
<p>The plaintiff alleges that the contract it entered into was for $2,000 a week for Breaux’s services plus an hourly rate for all workers he employed. Breaux asserts the defendant asked his business to perform work outside the scope of the project and also only paid for the first four invoices totaling $21,994.61. The plaintiff claims he is still owed $30,593.</p>
<p>The defendant is accused of breach of contract, misapplication of payments and unjust enrichment.</p>
<p>Damages in the amount of $30,593 are sought plus legal costs and attorney’s fees.</p>
<p>Breaux is represented by Timothy F. Hand of Gretna-based Hand, Holmes, Pilie &amp; Matthews LLC.</p>
<p>The case has been assigned to Division J Judge Stephen C. Grefer.</p>

<p>GRETNA – A Plaquemines Parish woman is suing a restaurant chain for injuries  received serious and disabling injuries in a fall in the women’s restroom.</p>
<p>Shelly E. Chiappetta filed suit against Hooters of Louisiana LLC; Gibson, Greco &amp; Wood Ltd., Blue Sky management Company LLC and Republic Underwriters Insurance Company in the 24th Judicial District Court on April 23.</p>
<p>Chiappetta claims she was a customer at the Hooters restaurant located at 4748 Veterans Blvd. in Metairie when she slipped on a freshly mopped wet and soapy floor in the women’s bathroom. The plaintiff alleges that no signs were in place to warn of the hazardous condition of the floor. Chiappetta asserts she received injuries to her head, neck, back, shoulders, jaw and spine.</p>
<p>The defendant is accused of failing to maintain the store in a prudent manner, failing to take proper precautions to keep the bathroom floors clean and free from foreign objects, creating an unreasonable risk of harm, creating a hazardous situation by mopping the bathroom floor, failing to place warnings signs, failing to exercise reasonable care, allowing a foreign soapy substance to remain on the bathroom floors and negligently supervising and training employees.</p>
<p>An unspecified amount in damages is sought for medical expenses, lost wages, loss of earning capacity, pain and suffering, permanent disability, mental anguish, loss of enjoyment of life, lost wages and loss of future earning capacity.</p>

<p>Lori E. Sumrall filed suit against Louisiana Affordable Properties LLC and James Wilson in the 24th Judicial District Court on April 29.</p>
<p>Sumrall claims that since Feb. 18, 1998 she has been the owner of a home located at 1022 Kepler St. in Gretna and that on April 19, 2103 she returned home to find Wilson had removed all of the belongings from her home and placed them outside the premises. The plaintiff alleges she called the police who arrested Wilson for trespassing.</p>
<p>However, Louisiana Affordable Properties had obtained an order of possession only a week earlier on April 12 that was signed by Judge Lee V. Faulkner in the 24<sup>th</sup> District Court. Sumrall asserts that she later found the property had been sold at a tax sale due to charges from the parish for cleaning up weeds on the property on two occasions that she had not paid. The plaintiff claims that she was never properly served by the sheriff&#8217;s office with a notice of the sale and therefore it should be void.</p>
<p>The defendant is accused of not properly removing and disposing of the plaintiff’s property after taking possession and not following appropriate court orders or eviction proceedings.</p>
<p>Damages in the amount of $70,000 is sought for broken doors, the removal of the plaintiff’s property, disturbance, inconvenience, invasion of privacy of the home, mental anguish, repairs to the plaintiff’s home, expenses and inconvenience of cleaning the home.</p>
<p>The plaintiff also seeks a temporary restraining order to prevent the defendants from abusing, harassing, threatening her or coming with 100 feet of her residence.</p>
<p>Sumrall is represented by Roy J.D. Gattuso of Gretna-based Vezina and Gattuso LLC.</p>
<p>The case has been assigned to Division O Judge Ross P. LaDart.</p>

<p>Michael V. Giangrosso, and wife Loretta, filed suit against Ochsner Clinic Foundation and its staff in the 24<sup>th</sup> Judicial District Court on May 7.</p>
<p>On Dec. 11, 2010, Giangrosso was admitted to the Ochsner emergency room complaining of abdominal pain and other symptoms. The plaintiff was diagnosed with possible gastrointestinal bleeding and anemia.</p>
<p>The Ochsner physician who saw Giangrosso ordered the administration of Nexium, a drug prescribed for excess stomach acid.</p>
<p>Ochsner nurses were summoned by Giangrosso’s wife to his bedside 12 hours later, where he was experiencing a seizure. At this point it was discovered that instead of Nexium the plaintiff was being administered insulin and his blood glucose levels had dropped to an undetectable level.</p>
<p>The defendant is accused of negligence and medical malpractice.</p>
<p>An unspecified amount in damages is sought for physical and mental pain and suffering, physical and mental impairment, economic losses, loss of consortium, aggravation of existing conditions and loss of a chance of better recovery.</p>
<p>The plaintiff is represented by attorney Kenneth V. Ward Jr. of Mandeville.</p>

<p>GRETNA – A Baton Rouge woman is suing a international discount retailer over injuries she claims to have received at one of its local stores.</p>
<p>Shauna Temple filed suit against Wal-Mart Louisiana Inc. in the 24th Judicial District Court on April 20.</p>
<p>Temple claims that on May 15, 2012 she was shopping at the Wal-Mart located at 1501 Manhattan Blvd. in Harvey when she slipped in a puddle of water near the freeze area. The plaintiff alleges the water came from an ice machine owned by the defendant. Temple asserts there was no way she could avoid the incident in which she received injuries.</p>
<p>The defendant is accused of allowing a hazardous condition to exist on the premises, failing to warn patrons of a dangerous condition which it knew or should have known existed, causing and allowing water to remain on the floor in an area which it knew or should have known would be highly traveled by patrons and failing to maintain the property so as to render it safe for patrons.</p>
<p>An unspecified amount in damages is sought for medical expenses, pain and suffering, wage loss and mental anguish.</p>

<p>GRETNA – A Pensacola, Fla. woman is suing a Metairie Marriott for injuries she claims to have received in a fall in its parking lot.</p>
<p>Paula R. Powell, and husband Roderick, filed suit against Marriott International Inc. and Marriott Hotel Services Inc. in the 24th Judicial District Court on April 19. Powell claims that April 22, 2012 she was on a concrete walkway outside of the Courtyard Marriott located at 2 Galleria Blvd. in Metairie when she tripped on an upturned slab of concrete and fell. The plaintiff alleges she received serious injuries in the fall. Powell asserts the piece of concrete she tripped on was not easily visible and constituted a hidden danger.</p>
<p>The defendant is accused of failing to maintain its premises free from unsafe conditions, failing to use reasonable and ordinary methods to keep the premises in a safe and suitable condition, failing to use reasonable care in discovering unsafe conditions, failing to adequately inspect the area, failing to take adequate protective measures against unreasonably dangerous conditions, having knowledge of a dangerous condition and failing to provide the public and the plaintiffs with a reasonably safe walking surface.</p>
<p>An unspecified amount in damages is sought for physical pain and anguish, mental pain and anguish, loss of enjoyment of life and likely permanent injuries.</p>

<p>GRETNA – A truck driver and his employer are being sued by a parking garage owner for damages he allegedly caused when he his truck struck an overhead sprinkler system.</p>
<p>PHFG Metairie LLC, FWF PHOV Metairie LLC, Fillmore West End LP and Fillmore Hospitality LLC filed suit against Convergint Technologies LLC, Kevin James Connor and their insurer in the 24th Judicial District Court on April 18.</p>
<p>The plaintiff alleges that Connor drove a truck that was beyond height restrictions into the New Orleans Marriott at Lakeway parking garage located at 3838 M. Causeway Blvd. in Metairie. The incident allegedly resulted in severe damage to the sprinkler system that extended into the hotel itself.</p>
<p>The defendant is accused of failing to maintain a proper lookout, failing to maintain proper control of vehicle, failing to see what should have been seen and failing to know height of vehicle.</p>
<p>An unspecified amount in damages is sought for all property damages.</p>
<p>The plaintiff are represented by Michael J. Vondestein of Hailey , McNamara, Hall Larmann &amp; Papale LLP.</p>
<p>The case has been assigned to Division B Judge Cornelius E. Regan.</p>

<p>The suit was filed against Crosby Marine Transportation LLC, AC Marine Inc., Seacor LB Offshore LLC, Master Marine Towing Inc., United Tugs Inc., Highland Marine LLC and their insurers in the 24th Judicial District Court on April 17.</p>
<p>Jefferson Parish states that it owns and maintains a water line feeding potable water from the mainland to barrier island community of Grand Isle. On July 2, 2012 it alleges the M/V Miss Stacie, M/V Mr. Nelson, M/V Seacor Power, M/V Larry J. Hebert, M/V Emmett Eymard and M/V Lauren A. struck and damaged the water line.</p>
<p>The defendants are accused of negligent hiring and training of crew and causing extensive damage to the water line.</p>
<p>Damages in the amount of $281,338.41 is sought for costs of repair and related expenses.</p>
<p>The Parish of Jefferson is represented by Assistant Parish Attorney W. Reed Smith of the Jefferson Parish Attorney’s Office.</p>
<p>The case has been assigned to Division N Judge Stephen D. Enright Jr.</p>
