Lawsuit claims personal trainer responsible for client's injuries

A New Orleans resident blames her personal trainer for injuries she says she suffered as a result of a weight-training program.

Accusing the trainer of negligence, Peggy Wallace filed a lawsuit against One to One Personal Training and Clinical Exercise Facility, Hiroshi Futogoishi and Nautilas Insurance Group May 18 in Orleans Parish District Court.

Wallace claims the personal trainer is responsible for instructing clients how to properly use weight training equipment and for determining the appropriate amount of weight to be used by the client. Wallace claims her trainer failed to give her proper instructions and did not properly assess her physical condition or select an appropriate weight-training program. Wallace says she suffered injuries in 2009 as a result.

According to court records, Wallace underwent surgery on her rotator cuff and bicep March 16, 2010.

"The relationship between Plaintiff and One to One/Hiroshi was in the nature of student and teacher and said Defendants, therefore, owed a heightened duty of care for Plaintiff and are answerable for damages incurred by Plaintiff while she was under their supervision," the complaint reads.

The plaintiff is seeking damages for physical pain and suffering, medical expenses, loss of enjoyment of life, interest and court costs.

New Orleans attorneys Laurence E. Best and Peter S. Koeppel of Best Koeppel Traylor are representing Wallace.

Judge Lloyd J. Medley is assigned to the case.
