An Ascension Parish woman's insurance provider is suing the manufacturer of an aquarium after it sprung a leak and damaged her apartment.
Allstate Insurance Company is suing Central Garden and Pet Co. for insurance payments awarded to Tonya Tyler after the alleged failure of an aquarium produced by the defendant damaged her home over two years after its purchase.
The suit asserts the aquarium had a manufacturing or design defect that resulted in over $16,000 in water damage to Tyler's home. The suit also is seeking recompense of the $1,000 deductible Tyler was responsible for under her insurance policy.
The plaintiff claims the defendants should be held liable because no warning was provided to Tyler. She claims she used the aquarium appropriately and the aquarium was dangerous in design, construction and composition.
The suit was filed on behalf of Allstate by Timothy R. W. Kappel, of the Tennessee-based Sloan Law Firm.
The case has been assigned to Division E Judge Alvin Turner, Jr.
