NEW ORLEANS – A Mississippi man is suing his employer claiming negligence after he tripped over piping on the deck of a barge and fell.
Travis R. Blanton filed suit against SCF Waxler Marine on June 27 in federal court in New Orleans.
The alleged incident occurred on July 16, 2011 as Blanton was working on the deck of defendant’s barge. Blanton states that he slipped and fell over piping on the deck, sustaining injuries.
The defendant is accused of negligence due to slippery conditions on the deck of the Waxler barge.
Blanton accuses the company of failing to properly man its vessel and assign an adequate number of people to the task then underway, failing to properly plan and analyze the work, failing to train its crew and for failing to warn him about the hazard or to take other actions to eliminate or lessen the hazard.
The plaintiff is asking the court for an award of damages for medical expenses, pain and suffering, mental anguish, disability, humiliation, embarrassment, wage loss, lost earnings, maintenance, cure, and interest.
Blanton is represented by John O. Charrier Jr. of Charrier & Charrier in Baton Rouge and Charles S. Norris Jr. of Norris Law Firm in Vidalia.
U.S. District Judge Eldon E. Fallon is assigned to the case.
