BATON ROUGE – A Livingston Parish woman is suing a Baton Rouge attorney for legal malpractice.
Barbara Henderson filed suit against Neil D. Sweeney, Sweeney law Firm LLC and Continental Casualty Co. in the 19th Judicial District Court on Feb. 6.
Henderson claims that she retained Sweeney to represent her in a case in which she was stuck in an elevator at Baton Rouge General Hospital and allegedly suffered injuries when she was pulled out.
The plaintiff alleges Sweeney failed to timely file a lawsuit in the case and she was not able to recover any damages as a result.
The defendant is accused of failing to timely file a lawsuit against parties responsible for the damage, failing to properly supervise office staff, failing to act within a degree of professional diligence and failing to properly and adequately keep their client informed of their professional obligations.
An unspecified amount in damages is sought for the value of her personal injury action had it been timely filed, loss of use and interest on monetary value of the personal injury claim and attorney’s fees.
Henderson is represented by Baton Rouge-based attorney Christopher L. Whittington.
The case has been assigned to Division M Judge Kay Bates.
