USPS worker sues bakery after sign allegedly fell on him

GRETNA – A postal worker who was delivering mail to a local bakery is suing after allegedly being injured when a sign fell on his head.

Eugene Nicholas filed suit against Antoine’s Bakery Inc., Gregory Antoine Sr., Raul J. Viera and their insurers in the 24th Judicial District Court on June 11.

As part of his job as a U.S. Postal Service employee Nicholas claims he was delivering mail to Antoine’s Bakery located at 1300 Stumpf Blvd. Suite A in Gretna when a sign fell off the side of the business and struck him. The plaintiff alleges that he received serious injuries in the incident. Nicholas asserts that the sign was unsecured due to ongoing repairs to the roof and that wind blew the sign off the roof as he walked by it.

The defendant is accused of failing to properly maintain property, failing to properly secure the sign, leaving the sign unattached on the roof and failing to see what should have been seen.

An unspecified amount in damages is sought for pain and suffering, mental pain and anguish, loss of earnings, medical expenses, loss of life’s enjoyment, attorney fees and court costs.

Nicholas is represented by James E. Shields Jr. of Gretna-based Shields & Shields APLC.

The case has been assigned to Division P Judge Lee V. Faulkner Jr.
