NEW ORLEANS - A hospital electrician has filed a discrimination lawsuit claiming he was terminated in retaliation for filing a worker’s compensation claim.
Hui G. Chen filed suit against Ochsner Clinic Foundation and Ochsner Clinic on Sept. 11 in federal court in New Orleans.
Chen was injured in a work-related accident on Sept. 25, 2011. He filed a workers compensation act and was off of work for approximately two months. He claims that after his return, he was subjected to systematic and international discrimination in direct retaliation and reprisal for having brought a claim of workers’ compensation. Chen claims he was terminated on April 19, 2012 in retaliation for his disability, race and his complaints of discrimination engaging in protected activity.
The defendants are accused of violating the civil rights act and the Americans with Disability Act.
The plaintiff is seeking an award of compensatory damages for loss of wages, earnings and earning potential, several emotional distress, pain and suffering, great bodily injury, special damages, punitive damages, court costs, attorney’s fees, and interest.
Chen is represented by Gonzales attorney Jean-Paul Robert. A jury trial is requested.
U.S. District Judge Mary Ann Vial Lemmon is assigned to the case.
