Minor who claims he was served alcohol at club before car accident sues

Underage drinking

GRETNA – A minor who crashed his car after leaving a local club is suing the owners of the club for illegally serving him alcoholic drinks.

Ray Conrad Sr. and Ray Conrad II filed suit against the Sunshine Boys and Girls Inc., Club Lax, Adolfo P. Herrera, Toby J. Lefort and their insurer in the 24th Judicial District Court on Oct. 23.

On Oct. 23, 2012 Ray Conrad II claims he was operating a vehicle on the Causeway Bridge going northbound when he lost control and collided with a cement support pole. The plaintiff asserts that in the hours before the accident he had been at Club Lax, operated by Herrera and Lefort, where he was served alcoholic drinks with workers' full knowledge that he was a minor. Ray Conrad II alleges the defendants are at fault for his painful and disabling injuries from the incident.

The defendant is accused of knowingly serving alcohol to a minor, failing to exercise reasonable care in preventing the purchase and consumption of alcohol by a minor on the premises, failing to instruct employees not to serve alcohol to minors, failing to properly check identification upon entering the bar, taking payment from a minor for purchase of alcohol in the form of a credit card and failing to properly check identification for use of a credit card.

An unspecified amount in damages is sought for property damage, monetary loss, loss of vehicle, physical pain and suffering, mental anguish, distress, humiliation and embarrassment, loss of enjoyment of life, loss of earning capacity, property damage, attorney’s fees and medical expenses.

The Conrads are represented by Kristina L.F. Ohlmeyer of New Orleans-based Ohlmeyer & Ohlmeyer LLC.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.
