GRETNA – A condominium association is suing its property insurance provider for allegedly breaching contract.
Metairie Towers Condominium Association Inc. filed suit against United National Insurance Company and Certain Underwriters of Lloyd’s London in the 24th Judicial District Court on Dec. 11.
Metairie Towers Condominium Association, a condominium association with approximately 219 condominium units, alleges it had casualty insurance providing up to $390,000 in coverage for named storms with United National Insurance Company. The plaintiff claims that when Hurricane Isaac struck the area on Aug. 29, 2012 its building suffered physical damage for which the defendant refused to provide coverage. Metairie Towers Condominium Association asserts United National Insurance Company denial of their claims was arbitrary and capricious and constitutes bad faith.
The defendant is accused of failing to provide timely payment and undisputed damages, breach of duty to properly adjust the insurance claim, breach of insurance contract and violation of state law.
An unspecified amount in damages is sought for payment for damages to structure, double the damages as provided by state law, 50 percent penalties for failing to submit payment with 30 days of proof of loss, engineering and construction fees, attorney’s fees and court costs.

The case has been assigned to Division J Judge Stephen C. Grefer.
