GRETNA – A nurse is suing her former employer claim she was terminated after being injured at work and receiving workers’ compensation.
Dawn McMillion filed suit against Jefferson Parish Hospital Service District No. 2 and Jefferson General Hospital in the 24th Judicial District Court on Dec. 19.
McMillion asserts that she was employed as a registered nurse at East Jefferson General Hospital since October 2005 and was earning in excess of $50,000 including her hourly wage and overtime. The plaintiff alleges that on Oct. 22, 2012 she was exiting a medication room when she injured her elbow on a door frame. She claims she informed the defendant and began to receive workers’ compensation benefits. McMillion claims that due to her worker’s compensation claim she was terminated by East Jefferson General Hospital who alleged that the reason they let her go was that she exhausted her leave time.
The defendant is accused of wrongful termination.
An unspecified amount in damages is sought for penalties, attorney’s fees and court costs.
McMillion is represented by W. Patrick Klotz of New Orleans-based Klotz & Early.
The case has been assigned to Division L Judge Donald A. Rowan Jr.
