GRETNA – A man who claims he was in a hit and run car accident is suing his own car insurer for not covering damages to his vehicle even though he had coverage protecting him from uninsured drivers.
Joseph A. Genovese filed suit against an unknown driver and American National Property and Casualty Company in the 24th Judicial District Court on Jan. 27.
Genovese alleges that on Feb. 3, 2013 he was turning northbound onto North Causeway Boulevard in Metairie when his vehicle was rear-ended by another car that fled the scene. The plaintiff claims that the unknown driver was found to be in violation of laws governing hit and run accidents. Genovese asserts his car was damaged in the accident, but his insurance company has failed to pay for repairs and injuries he sustained despite being liable under the contract for damages caused by uninsured drivers.
The unknown driver is accused of accused of negligence leading to the accident.
American National Property and Casualty Company is accused of and breach of contract for not paying for damages.
An unspecified amount in damages is sought for mental anguish, physical pain and suffering and physical disability.
Genovese is represented by J. Douglas Sunseri of Metairie-based Nicaud & Sunseri LLC.
The case has been assigned to Division G Judge Robert A. Pitre Jr.
