Couple sue owner of Bobcat excavator that allegedly caused car accident

GRETNA – A construction company and one of its employees are being sued by a couple who claim they were injured when they collided with a piece of construction equipment that pulled out in the path of their car.

Marilyn G. and Lewis W. Hopkins filed suit against Richard J. Laborde, Laborde Construction Company Inc. and Omar Rodriguez in the 24th Judicial District Court on Feb. 11.

The Hopkinses claim they were driving their 2002 Toyota Camry on Chickasaw Avenue in Metairie on Oct. 12, 2013 when a Bobcat construction vehicle driven by Rodriguez, while in the scope his work for Laborde Construction, backed out of a residential lot and into their car. The plaintiffs assert that in the incident Marilyn violently struck her left shoulder on the driver's side door and in the process also injured her neck, back and head.

The defendant is accused of reckless operation, failing to keep a lookout, failing to see what should have been seen and operating a construction vehicle on a public street without a license or proper training.

An unspecified amount in damages is sought for medical bills, anxiety, loss of enjoyment of life, permanent disability, lost earnings and lost earning capacity.

The Hopkinses are represented by Henry T. Dart of Covington-based Henry Dart, Attorneys at Law.

The case has been assigned to Division D Judge Scott U. Schlegel.
