Painting and cleaning company sued by subcontractor over use of equipment

GRETNA – A subcontractor is suing a painting and cleaning company over a dispute of whether they should be charged for using their equipment while fulfilling three subcontracts worth $24,000.

C.R. Contractors LLC filed suit against Southern Cleaning and Restoration and John Curry in the 24th Judicial District Court on April 10.

C.R. Contractors asserts that it entered into subcontractor agreements with Southern Cleaning and Restoration between April 25 and May 8, 2012 in which it agreed to perform work for a specific price. All together the plaintiff claims it is owed $24,035 for the three subcontracts.

C.R. Contractors alleges that Southern Cleaning and Restoration, and its manager Curry, subtracted amounts out of the contract for allowing the use of its equipment in performance of the subcontracting work. The plaintiff asserts that although it used the equipment there was no lease agreement for the equipment use and there should not have been any amount subtracted from the original contract.

The defendant is accused of breach of contract.

An unspecified amount in damages is sought for full payment of the amount owed.

C.R. Contractors is represented by Gloria T. Lastra of New Orleans-based Braden Gonzalez and Associates.

The case has been assigned to Division C Judge June Berry Darensburg.
