NEW ORLEANS – A local discount retailer is being sued by a woman who claims she was injured in a slip and fall on their premises.
Joycelyn Dominick filed suit against Dollar Tree Stores Inc. and its insurance company in the Orleans Parish Civil District Court on Jan. 30.
Dominick alleges that on Oct. 4, 2013 she slipped in a puddle of water leaking from a refrigerator in the Dollar Tree on Canal Street in New Orleans. As a result of the fall she claims to have suffered injuries to her ankle and knee.
The defendant is accused of failing to adequately inspect and maintain the store in a reasonably safe condition, failing to warn persons of defects/hazards that existed in the area, failing to correct the condition that existed and of having initially created the hazardous condition.
Dominick is suing for damages including medical expenses, mental and physical pain and suffering, functional impairment and physical disability.
The plaintiff is represented by attorney T. Peter Breslin of Metairie.
Dollar Tree answered the suit on March 3, denying all wrongdoing, claiming that any fault, negligence or any other liability rests with the defendant. It is represented by John J. Rabalais, Janice B. Unland and Bagriel E.F. Thompson of Rabalais Unland.
Case is assigned to Division G Judge Robin M. Giarusso.
