Doctors accused of medical malpractice in case of misdiagnosis of brain inflammation virus

GRETNA – A woman is suing a number of doctors she claims failed to properly treat her when she was suffering from a virus that allegedly caused her brain to become inflamed.

Kimberly Rials Lafleur and her family filed suit against Frank J. Rabito M.D., Terry G. Creel M.D. and Richard E. Deno M.D. in the 24th Judicial District Court on May 1.

Lafleur alleges she presented to the defendants with herpes simplex encephalitis, a rare brain inflammation disease caused by the same virus the causes cold sores. The plaintiff claims that the defendants failed to timely diagnose her condition and provide proper treatment. Lafleur asserts that due to the delay in treatment her injuries were worse than they would have been otherwise.

The defendant is accused of deviating from the acceptable standard of care, mismanaging the medical care of the plaintiff and failing to timely diagnose and treat the plaintiff’s condition.

An unspecified amount in damages is sought for physical pain and suffering, mental; anguish, emotional distress, medical expenses, disability, miscellaneous expenses, lost wages, diminution of employability and loss of enjoyment of life.

Lafleur is represented by T. Carey Wicker of New Orleans-based Capitelli & Wicker.

The case has been assigned to Division I Judge Nancy A. Miller.
