Foot Locker sued by customer allegedly injured after stepping on security tag

GRETNA – A corporate shoe store is being sued by a St. John the Baptist Parish woman who was allegedly injured after she stepped on a clothing security tag that punctured her foot.

Belinda Simmons filed suit against Foot Locker Stores Inc., Kids Foot Locker and their insurers in the 24th Judicial District Court on June 20.

Simmons alleges she was a customer at the Foot Locker store located at 1401 W. Esplanade Ave. in Kenner on Dec. 23, 2013 when she stepped on a security tab that stuck into her foot. The plaintiff claims she sustained injuries to her foot and leg in the incident that required medical treatment.

The defendant is accused of failing to train personnel properly, failing to properly inspect floors and building, failing to place warnings signs and failing to exercise due care.

An unspecified amount in damages is sought for medical expenses, pain and suffering, psychological damage and emotional distress.

Simmons is represented by attorney Tomy J. Acosta of LaPlace.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
