Sam’s Club sued by customer who allegedly hit head on pallet in fall

GRETNA – A corporate retailer is being sued by a shopper who claims she was severely injured when she hit her head after slipping and falling on an empty pallet.

Dion Roberts filed suit against Sam’s West Inc. in the 24th Judicial District Court on June 25.

Roberts contends on Oct. 20, 2013 she was shopping for toilet tissue at the Sam’s Club located in Harvey when she attempted to step over pallet to each goods located behind it when she slipped and fell to the ground. The plaintiff alleges she violently struck her head on the empty pallet and hit her hip on the ground when she fell. Roberts claims she received injuries to her head, arms and hip in the incident.

The defendant is accused of failing to properly maintain product displays, failing to warn patrons of defective product dip lays, failing to correct an unreasonably dangerous situation, failing to restock displays, failing to remove empty pallet, failing to move merchandise forward, failing to monitor inventory and failing to do what should have been done.

An unspecified amount in damages is sought for physical pain and suffering, medical expenses, loss of wages, loss of earning capacity, loss of enjoyment of life, scarring, disfigurement and disability.

Roberts is represented by Joseph S. Piacun of Metairie-based Gennusa, Piacun & Ruli.

The case has been assigned to Division N Judge Stephen D. Enright Jr.
