Winn Dixie sued after woman allegedly slips on spilled rice, claims severe injuries

NEW ORLEANS – A New Orleans woman is suing a grocery store chain for allegedly allowing rice to remain spilled in an aisle of one of its local stores that led to her receiving severe injuries when she slipped and fell on it.

Viola Joiner filed suit against Winn Dixie Louisiana Inc. in the Orleans Parish Civil District Court on Aug. 12.

Joiner claims that on Dec. 19, 2013 she was shopping at the Winn Dixie located at 5400 Tchoupitoulas St. in New Orleans when she slipped and fell on rice spilled on the floor in the rice aisle. The plaintiff asserts that the fall caused severe injuries to her shoulder, left knee, head, neck and back.

The defendant is accused of negligence, including failure to properly train employees in the stocking of shelves, failure to warn of an unreasonably dangerous condition and failure to properly maintain and inspect the premises.

The plaintiff seeks damages in excess of $50,000 for physical pain and suffering, mental anguish, medical expenses and loss of enjoyment of life.

Joiner is represented by attorney A.J. Rebennack.

The case has been assigned to District N Judge Ethel S. Julien.
