Customer sues after alleged injury that occurred in trip over floor mat

GRETNA – A local grocery store is being sued by a customer who claims she was injured after tripping on a floor mat at the store’s entrance and falling to the floor.

Samruary Armand filed suit against Winn Dixie Louisiana Inc. in the 24th Judicial District Court on Sept. 29.

Armand claims that on Nov. 6, 2013 she was walking into the Winn Dixie located at 2104 Williams Blvd. in Kenner when she tripped on a buckled mat and fell to the floor. The plaintiff alleges she received injuries to her arm, leg, hand and leg in the incident.

The defendant is accused of failing to properly replace worn and defective rugs, failing to properly maintain and inspect the premises, failing to warn of an unreasonably dangerous condition and failing to use prudent care under the circumstances.

Damages in excess of $50,000 are sought for physical pain and suffering, mental anguish, medical expenses, loss of enjoyment of life and loss of earning capacity.

Armand is represented by attorney A.J. Rebennack of Metairie.

The case has been assigned to Division N Judge Stephen D. Enright Jr.
