Restaurant owners sued for breach of contract

NEW ORLEANS – A New Orleans-based construction company is suing a Garden District restaurant for an alleged breach of contract for failing to pay for design and construction services.

Ellis Construction Inc. filed suit against Mayas Restaurant Group LLC in the Orleans Parish Civil District Court on March 3.

The plaintiff asserts that it entered into a written contract with the defendant to provide design and construction services, specifically MEP design services related to the renovation of Mayas Restaurant. The agreed-upon amount was allegedly a lump sum price of $33,302.50. The plaintiff claims that services were completed in accordance with the contract and two invoices were issued totaling $32,549.50. The plaintiff alleges that it has repeatedly demanded payment and without any justifiable reason has received none.

The plaintiff seeks damages in the amount of outstanding payments owed on the invoices plus interests as well as costs related to the loss of use of the funds as well as attorneys' fees.

The plaintiff is represented by Terrence L. Brennan, Kelly E. Theard and Scott J. Hedlund of New Orleans-based Deutsch Kerrigan & Stiles LLP.

This case has been assigned to Divison G Judge Robin M. Giarrusso.
