Masonry company files $79K lawsuit against contractors over allege non-payment

GRETNA – A masonry company claims it was never paid for a subcontract to provide work on a local construction project.

Rush Masonry Inc. filed suit against Christopher Homes Inc. and TKTMJ Inc. in the 24th Judicial District Court on March 3.

Rush Masonry Inc. asserts it entered into a subcontract worth $79,445.66 to provide masonry work for Christopher Homes Inc. and TKTMJ Inc. on the Metairie Manor project located at 4937 York St. in Metairie. The plaintiff claims the subcontract provided that the defendants would pay for all material and work provided on the project. However, Rush Masonry Inc. alleges despite completing all work on the project in a timely and proper manner the defendants have refused to pay them.

The defendant is accused of breach of contract and failure to promptly pay.

Damages in the amount of $79,445.66 plus attorney’s fees is sought by the plaintiff.

Rush Masonry Inc. is represented by H. Minor Pipes of New Orleans-based Barrasso Usdin Kupperman Freeman & Sarver LLC.

The case has been assigned to Division J Judge Stephen C. Grefer.
