GM sued by family of man who allegedly died after airbag malfunctioned in accident

General motors

GRETNA – The family of a man who died in a car accident while driving a Saturn car is suing its manufacturer claiming his death may have been prevented if an air bag had deployed instead of malfunctioning.

Sandra Lanier Isom, Janice Isom, Kimberly Isom and Shelita Leggett filed suit against General Motors Company and their insurer in the 24th Judicial District Court on March 8.

The plaintiffs allege that on March 8, 2014 James Isom was driving a 2004 Saturn Ion on Clay Street in Kenner when his vehicle collided with a pole and his vehicle’s airbag failed to deploy. Due to the accident Isom suffered fatal injuries to his face and head, which the plaintiffs contend the defendants should be held responsible because they were the manufacturers and designers of the faulty vehicle.

The defendant is accused of creating an unreasonably dangerous constructed car, creating a car that is unreasonably dangerous in design and not publishing warnings concerning defects.

An unspecified amount in damages is sought for medical expenses, mental pain and suffering, mental anguish, mental distress, loss of society, loss of love and affection and loss of companionship.

The plaintiffs are represented by Charles V. Cusimano III.

The case has been assigned to Division L Judge Donald A. Rowan Jr.

Case no. 747-445.
