Dunkin Donuts owner accuses subcontractor of unpermitted work, ordering wrong refrigeration unit

GRETNA – The owner of a local Dunkin Donuts is suing a subcontractor who allegedly ordered the wrong refrigerator until to be installed in their store and did unpermitted work on the subcontract.

Sri Silva Durga Properties LLC filed suit against Johnny Romero, Johnny Romero Builder’s LLC, United Remodeling and Construction, Ricardo Sequeira and United Remodeling and Construction LLC in the 24th Judicial District Court on March 10.

Sri Silva Durga Properties says it owns a Dunkin Donuts located at 4300 Veteran’s Memorial Blvd. in Metairie and that on Jan. 2, 2014 it entered into a construction contract with United Remodeling and Construction to install a refrigeration unit at the property. The plaintiff alleges the job was subcontracted to Johnny Romero Builder’s that included $15,000 worth of work that was to include permitting and inspections.

Sri Silva Durga Properties contends that a change order further increased the price of Johnny Romero Builder’s subcontract in the amount of $5,810 for which they were purportedly paid $2,000 in cash by Sri Silva Durga Properties. Further, the plaintiff asserts the defendants order the wrong refrigeration unit to be installed on the premises.

In addition, Sri Silva Durga Properties claims Johnny Romero Builder’s  as cited by Jefferson Parish for working without a permit, installing a fence without a permit and failing to comply with the approved site plan all of which resulted in the necessitation of a redesign of the project.

The defendant is accused of breach of contract.

An unspecified amount in damages is sought for cost to install the wrong refrigeration unit, amount of contract and change order, amount of cash paid for change order, cost of the inappropriate change order, cost of shipping for the wrong refrigeration unit and cost of code violations.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.
