Condo association sued after woman claims foot was mangled when automatic gate closed on it

GRETNA – A local condominium association is being suing by a woman who claims her foot was injured on two separate occasions when an automatic gate closed on it, resulting in significant damage and a lingering infection.

Lakeisha Hayes filed suit against Nautilus Insurance Company and The Riverside Court Condominium Association Phase II Inc. in the 24th Judicial District Court on March 19.

Hayes asserts she was visiting the Riverside condos located at 6300-20 Riverside Drive in Metairie when on two separate occasions on March 12, 2014 and April 18, 2014, when her foot was caught in an automatic metal gate that slammed shut on it as she was entering the property. The plaintiff claims the incidents caused significant damage to her left heel and left big toe that resulted in an infection requiring extended medical treatment.

Hayes alleges the gate that caused the accident was broken and that the defendants should have known about its dangerous condition and fixed it before it hurt anyone.

The defendant is accused of failing to properly adjust the automatic gate, failing to inspect the gate, crating an unreasonable risk of harm, failing to use reasonable care, failing to adequately warn of the danger, failing to properly inspect the premises and failing to train and supervise employees.

Damages in an amount not to exceed $50,000 are sought by the plaintiff for pain and suffering, mental anguish, distress, medical expenses and loss of enjoyment of life.

Hayes is represented by attorney Leonard J. Cline of Metairie.

The case has been assigned to Division A Judge Raymond S. Steib Jr.
