Allstate sued for allegedly not providing proper damage payment on hailstorm damaged home

GRETNA – A corporate insurer is being sued by a local homeowner who claims the company failed to fully cover damages that his home suffered in a hailstorm.

Roosevelt Haten filed suit against Allstate Insurance Company in the 24th Judicial District Court on Feb. 23.

Haten contends he had homeowner’s insurance provided by Allstate Insurance Company in place on his home located at 1149 Maplewood Drive in Harvey when a hailstorm struck the area on Feb. 24, 2013. The plaintiff claims his roof was severely damaged in the storm and resulted in water damage to the home’s interior and exterior as well as its contents. Haten alleges Allstate failed to properly inspect, estimate, adjust and pay for the damages to his home. Subsequently, the plaintiff maintains the defendant has failed to provide an adequate claim for the actual cost of damages to his home.

The defendant is accused of breach of contract, bad faith claims handling, negligent claims handling, breach of duty, non-prompt payment and violation of state law.

Damages in excess of $50,000 are sought for diminution in value of property, repair and remediation expenses, amount due under the policy not previously paid, cost to hire professional firms, consequential damages, property damage, loss of use, attorney’s fees and litigation costs.

Haten is represented by Tiffany R. Christian of New Orleans-based Binegar Christian.

The case has been assigned to Division B Judge Cornelius E. Regan.
