Family Dollar sued by elderly woman claiming trip and fall over container of water from faulty A/C unit

BATON ROUGE – An elderly woman is suing a local Family Dollar store claiming she was severely injured after falling while shopping.

Dolly Gustefferson filed suit against Family Dollar Stores of Louisiana Inc., Tara Corporation of Mississippi, United Specialty Insurance Company, Kennic Inc., Wilkinson Construction LLC and Liberty Mutual Insurance Company in the 19th Judicial District Court on April 2.

The plaintiff claims that she was shopping at the Family Dollar store at 13559 Old Hammond Highway in Baton Rouge on May 2, 2014. Gustefferson states that as she turned to go down an aisle she tripped and felled over a plastic storage container. According to the lawsuit, the storage container was filled with water because it was placed beneath a dripping air conditioner unit. Gustefferson contends that she was severely injured in the incident.

The defendant is accused of failing to keep a proper lookout for leaking residue, failing to warn customers of potential unsafe conditions, failing to clean up liquid stance right away, failing to properly inspect the store floor and failing to have real knowledge of hazardous condition.

The plaintiffs suffered many injuries from neck pain, back pain, hip pain, shoulder pain, and headaches; however, an unspecified amount in damages is sought for medical expenses, physical pain, loss of wages, mental anguish and loss of enjoyment.

Attorney Scott M. Emonet of Murphy Law Firm in Baton Rouge represents the plaintiff.

The case has been assigned to Division F Judge Timothy Kelley.
