Wal-Mart sued by woman who claims she was injured after being dragged through parking lot by defective scooter

GRETNA – A local Wal-Mart is being sued by a woman who claims she was dragged through its parking lot by a defective scooter sustaining several injuries and having her clothes torn off before the vehicle collided with a pole.

Sharron Federico, and mother Vivienne Federico, filed suit against Wal-Mart Stores Inc. and their insurer in the 24th Judicial District Court on April 20.

Sharron Federico asserts that on April 23, 2014 she and her mother were shopping at the Wal-Mart located at 8912 Veterans Memorial Blvd. in Metairie. Due to special needs, Sharron Federico claims she used a motorized scooter, which she has on many occasions, provided by the defendant and that while doing so the vehicle malfunctioned and went out of control. Sharron Federico alleges that she tried to apply the scooter brakes, but it kept on going and that when she jumped from the vehicle her foot got caught on it, subsequently causing her to be dragged through the parking lot and have part of her clothes ripped off before the scooter crashed into a pole.

As a result of the incident Sharron Federico contends she suffered numerous injuries to her head, back, knees, legs, elbows, arm, neck as well as a concussion for which she received treatment at a hospital emergency room.

The defendant is accused of failing to remove the defective scooter, failing to inspect the scooter, failing to maintain the scooter, failing to provide proper maintenance, failing to take into account customer safety, failing to supervise employees and contractors and crating an unsafe and hazardous condition.

An unspecified amount in damages is sought for medical expense, pain and suffering, emotional distress, mental anguish,

The case has been assigned to Division E Judge John J. Molaison Jr.
