Xavier University accused of constructing building on neighbor’s land without permission

Xavieruniversity

NEW ORLEANS – Xavier University of Louisiana is being sued by a woman who owns a piece of property neighboring the university’s campus claiming it developed a building on her property without her permission.

Leola Williams filed suit against Xavier University of Louisiana in Orleans Parish District Court on April 10.

Williams claims that in 2014 the defendant constructed a building as well as a fence, which gradually moved onto her property. On Dec. 1, 2014 the plaintiff, through her attorney, claims she made a non-confrontational demand to the defendant for the removal of the alleged intrusion. Williams purports that the defendant responded by phone that it had a land survey stating that no intrusions were made and that it would forward the survey to her attorney. However, the plaintiff contends that she has never received a copy of the land survey despite repeated requests through her attorney.

The defendant is accused of refusing to remove a property that is an intrusion to the local resident living in the area.

An unspecified amount in damages is sought for the ordering of the removal the building and fence, mental anguish, inconvenience, aggravation and attorney’s fees.

The case has been assigned to Division N Judge Ethel S. Julien.

Case no. 2015-03471.
