Taxi driver sued for allegedly running over bicyclist

GRETNA – A bicyclist is suing a taxi cab driver for allegedly running him over.

Richard Ory filed suit against Mahmoud Ismael and Atlas Financial Holdings Inc. in the 24th Judicial District Court on May 4.

Ory claims that on May 4, 2014 he was riding his bicycle on West Esplanade Ave. in Metairie when Ismael drove his taxi cab out of a driveway, striking him in the process. The plaintiff alleges he was injured in the incident and that Atlas Financial Holdings Inc., which provided auto insurance for Ismael, has failed to pay an insurance claim.

The defendant is accused of operating his vehicle in a negligent manner, failing to exercise reasonable care, failing to see what should have been seen, failing to yield to a pedestrian and failing to maintain proper vigilance.

An unspecified amount in damages is sought for bodily injury, mental anguish, inconvenience, aggravation, pain and suffering, loss of wages, loss of capacity to work, medical expenses and property damage.

Ory is represented by Keith A. Conley of New Orleans-based Brandner Law Firm LLC.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
