Bent’s RV sued by customer claiming they were sold defective vehicle

GRETNA – A local recreational vehicle dealer is being sued a customer who claims he was sold a defective vehicle.

Clifford Wuertz filed suit against Bent’s RV, Brian Bent and Heartland Recreational Vehicle LLC in the 24th Judicial District Court on May 7.

Wuertz contends that on April 21, 2013 he purchased a new 2011 Eldridge Fifth Wheel recreational vehicle from Bent’s RV Center in Kenner. The plaintiff asserts that since he purchased the vehicle it has been defective including leaking windows, water damage and the growth of mold and mildew inside the vehicle. Wuertz claims the defects he discovered existed at the time of sale and that the recreational vehicle had 30 invoices for water damage.

The plaintiff alleges the defendants failed to fix the vehicle before selling it to him and never disclosed the problems the vehicle had experienced and its defects.

The defendant is accused of unfair trade practices, deceptive trade practices, failing to properly maintain the vehicle prior to its sale and failing to properly repair the vehicle.

The plaintiff is seeking that the sale of the vehicle be canceled and rescinded plus reimbursement of purchase price, insurance costs, customizing expenses and attorney’s fees.

Wuertz is representing himself pro se.

The case has been assigned to Division G Judge E. Adrian Adams.
