NEW ORLEANS - A maritime worker has filed suit against his employer following a 2015 accident that allegedly caused back injuries.
Farrell Schexnayder sued REC Marine Logistics LLC on charges of negligence in a workplace accident resulting in serious spinal injuries in April 2015.
Schexnayder was employed by REC Marine Logistics LLC aboard the M/V ELIE CHERAMIE. The suit states that the defendant was in breach of duty of reasonable care, failing to provide a safe work environment, train and supervise the plaintiff, implement minimum safety requirements, and provide adequate equipment and personnel.
According to the suit, the accident rendered the plaintiff unfit for duty and incapable of returning to work as a seaman. The complaint alleges pain, suffering and anguish, loss of wages, benefits and enjoyment of life, disability and medical expenses. The exact nature and circumstances of the accident were not described in the lawsuit.
Punitive damages are requested for potential failure to pay maintenance and cure, any gross negligence, or unseaworthiness of the vessel.
Requesting compensatory, special, and general damages in excess of $75,000, maintenance and cure, pre- and post-judgment interest, attorney’s fees, expenses, and court costs, Schexnayder is represented by Timothy Young, Tammy Harris, Megan Misko and Daniel Poolson of The Young Firm in New Orleans.
