Winn-Dixie, cleaning service sued by woman in slip and fall case

A New Orleans woman is suing the supermarket chain Winn-Dixie Louisiana Inc. and its cleaning service, Southern Cleaning Services Inc., for injuries she sustained in a slip and fall, according to a suit filed in Orleans Parish District Court on March 2.

The suit, filed by New Orleans attorney Ford Hardy Jr., alleges that plaintiff Chantress Wilson was "caused to slip and fall forward due to a liquid substance on the floor of the defendant's premises" on June 30, 2008. The suit also claims that Wilson suffered injuries to her neck, mid back, low back, head, both knees and both legs.

In addition to the injuries she suffered on site, the suit states that "MRI testing of plaintiff indicates herniation at L5-S1, which condition was cause or aggravated by the accident herein." The suit pleads that Winn-Dixie Louisiana and Southern Cleaning Services are liable for up to $75,000 in damages.

The suit names Winn-Dixie Louisiana as liable "due to the defective and unreasonably dangerous conditions of the premises" and that "Southern Cleaning Services, Inc. is liable for allowing a defective condition to exist at a Winn-Dixie Louisiana, Inc. store which it was contract to clean and/or maintain."
