Archdiocese of New Orleans, apartments sued over walkway trip

In a complaint filed in the Orleans Parish District Court, Monsignor Wynhoven Apartments, Roman Catholic Church for the Archdiocese of New Orleans and Catholic Mutual Relief Society of America, all from New Orleans, are being sued for injuries allegedly suffered when a resident tripped on a walkway.

According to the suit filed May 4, Malcolm Prejeant was walking on a designated walkway at the Monsignor Wynhoven Apartments on June 12, 2009, when he tripped and fell down due to an allegedly defective and hazardous section of the walkway which was broken, uneven and unlevel. Prejeant suffered injuries which required medical treatment, the suit claims.

The complaint alleges that the defendants breached their duty to Prejeant claiming that they were responsible and obligated to ensure that the elderly patrons of the apartments had a safe living area, free of hazardous and defective conditions.

Prejeant is seeking relief for injuries sustained in the fall including; pain and suffering, medical expenses, permanent disability, emotional distress and depression and all other damages to be proven at the time of trial.
