Passengers sue Transit Authority after bus hits parked vehicle

Two public transportation passengers are suing the Regional Transit Authority after the bus they were riding in struck the side of a parked utility vehicle causing them to sustain injuries.

Debra Prosper and Virginia Peck filed suit against Regional Transit Authority and Transit Management of Southeast Louisiana and James Nero on May 14 in the Orleans Parish District Court.

The plaintiffs accuse the driver of negligence for failing to maintain proper control of the vehicle, failing to maintain proper lookout, failing to avoid striking another vehicle, driving in a careless and reckless manner, failing to use reasonable vigilance, traveling at too great of speed, inattentiveness and failing to obey traffic laws.

Prosper claims she injured her back and reinjured her knee and is now suffering from headaches and dizziness. Peck claims she injured her arm, shoulder, and rib and is also suffering from headaches.

Prosper and Peck are seeking damages for physical pain and suffering, mental pain and suffering, medical bills, interest, and court costs.

New Orleans attorneys Allan Berger and Norman F. Hodgins III of Allan Berger & Associates, P.L.C are representing Prosper and Peck.

Judge Ethel S. Julien is assigned to the case.
