Wal-Mart slip and fall suit set for bench trial

A slip and fall suit involving a New Orleans Wal-Mart is set to go to bench trial on June 21 in Orleans Civil District Court.

New Orleans resident Joyce Miller is suing Wal-Mart Louisiana LLC after she slipped and fell on "red liquid," which allegedly caused her serious injuries.

New Orleans attorney William Mura Jr. filed the suit in July 2009 on behalf of Miller.

Metairie attorney Isidro DeRojas is representing Wal-Mart in the suit.

The suit alleges that Wal-Mart was negligent for Miller's injuries for failure to maintain its premises, warn guests of known dangerous conditions and adequately inspect property, among other charges.

The original petition for damages cites Louisiana Code of Civil Procedure Article 893 and states that Miller's "individual damages does not exceed the specific amount of damages necessary to establish the right to a jury trial."

Orleans Parish Judge Robin Giarusso is presiding over the case.
