Residents of St. Tammany Parish have filed a lawsuit against their home's builder and drywall supplier after discovering their home contains defective Chinese drywall.
Jeff, Robin and Amber Cathcart filed the claim against Interior Exterior Building Supply, Interior Exterior Enterprises, Scott Designer Homes, The North River Insurance Co., Arch Insurance Co., Liberty Mutual Insurance Co., Landmark American Insurance Co., Fireman's Fund Insurance Co., and ABC Insurance Co. June 14 in Orleans Parish District Court.
The Cathcarts bought the home on Madisonville's Timberwood Drive May 21, 2008.
According to the lawsuit, the house was designed and built using defective products and components including Chinese drywall. The Cathcarts say the drywall in the home renders it defective, unfit and useless for its intended purpose.
Causes of action filed against the defendants include violations of Louisiana civil code, warranty against redhibitory defects, the warranty of fitness for a particular purpose and fitness for ordinary use and the warranty of merchantable quality, violations of Louisiana Products Liability Act and negligence.
The petitioners seek damages for the purchase price of the home plus interest, expenses, losses and damages, court costs and attorneys' fees.
The Cathcarts are represented by New Orleans attorneys Gregory Di Leo and Jennifer B. Eagan, Cynthia St. Amant and Melissa Fuselier of Kanner & Whiteley and Hugh Lambert, Linda Nelson and Cayce Peterson of Lambert & Nelson.
Judge Madeline M. Landrieu is assigned to the case.
