Shopper sues store after stepping on broken glass

A Big Lots shopper is suing the store after she says she stepped on broken glass and cut her foot.

Nicole Bordley filed suit against Big Lots Stores, Inc. and Arch Insurance Co. May 13 in Orleans Parish District Court. The defendants removed the case to federal court in New Orleans in June.

Bordley says that in September 2009, she stepped on broken glass which penetrated her flip-flop and cut her foot.

Bordley argues the store knew or should have known that the glass was on the floor and presented a dangerous condition.

Big Lots is accused of negligence for failing to provide proper maintenance, failing to keep their premises in a safe condition for customers, failing to make timely inspection of the area, failing to properly train and supervise employees and failing to remedy an unsafe and hazardous condition.

Bordley is seeking damages for pain and suffering, medical expenses, permanent disability, loss of wages and earning capacity, interest and court costs.

New Orleans attorney J. Bart Kelly of Alvendia, Kelly & Demarest is representing Bordley.

U.S. District Court Mary Ann Vial Lemmon is assigned to the case.
