Customer sues Wal-Mart for getting 'clocked' in the head

A Wal-Mart customer is suing after she was allegedly hit in the head by a falling clock.

Hayfaa Baroud filed a lawsuit against Wal-Mart Stores July 21 in federal court in New Orleans.

The alleged incident occurred in November 2009 at Wal-Mart store #553 in St. Tammany Parish.

Baroud claims she was sitting in a store-owned chair when a large clock fell from the wall, hitting her on the head. She says she suffered serious injuries.

Wal-Mart is accused of negligence for failing to warn regarding the existence of dangers, failing to respond to complaints regarding unsafe conditions, not repairing deficiencies, failing to inspect the property, negligent construction, building, or setting-up of the clock, negligent supervision and not equipping the appurtenance with proper safety guards.

She is seeking damages for mental pain and suffering, physical pain and suffering, medical expenses, lost wages, loss of earning capacity, inconvenience, loss of enjoyment of life, permanent injury, interest and court costs.

Baroud is represented by New Orleans attorneys Anthony D. Irpino and K. Adam Avin of Irpino Law Firm.

U.S. District Judge Eldon E. Fallon is assigned to the case.
