Seaman sues over asbestos exposure

A Louisiana resident has filed suit against his former employer, claiming the employer failed to provide a safe place to work and allowed him to be exposed to asbestos.

Jerry Foster filed suit against J. Ray McDermott Inc. and McDermott Inc. on June 21 in the Southern District of Texas, Houston Division. The defendant moved the case to the federal court in New Orleans on Aug. 31.

Foster worked for the defendant from 1991 until 2000 as a welder-helper and pipe welder working laying pipeline on the floor of the Gulf of Mexico.

He accuses the defendants of failing to provide him with safe and appropriate tools for work or a safe workplace, failing to ensure safe guidelines, failing to adequately train and supervise its employees and failing to identify and warn of known hazards.

Foster is also claiming he was exposed to hazardous qualities of noise in the work site.

Foster is seeking damages for physical pain and suffering, mental anguish, loss of earning capacity, physical impairment, mental anguish, medical expenses, loss of household services, fear of future cancer, maintenance and cure plus interest, court costs and attorney fees.

Foster is represented by Bruce A. Craig of The Carlile Law Firm in Marshall. A jury trial is requested.

U.S. District Judge Martin L.C. Feldman is assigned to the case.
