A seaman has filed a lawsuit against his employer after he was involved in an accident that has left him unable to work.
Kerry Alexander filed suit against Orion Construction on Sept. 8 in federal court in New Orleans.
The incident occurred on July 19, 2010 as Alexander was working aboard an Orion-owned pipe-lay barge. Alexander claims he experienced an accident which caused painful injuries to his right hand.
Orion Construction is accused of negligence for breaching a legally imposed duty of reasonable care owed to Alexander, failing to provide a safe place to work, failing to properly train and supervise Alexander, failing to take any precautions for the safety of Orion's employees and failing to provide minimum safety requirements, equipment and personnel. The defendant is also accused of creating and maintenance of an unseaworthy vessel.
Alexander is seeking damages for physical, mental, emotional pain and suffering, loss of wages, fringe benefits, wage earning capacity, physical disability, medical expenses, maintenance and cure benefits, attorney's fees, punitive damages, interest and court costs.
He is represented by Timothy J. Young, Robert J. Young, Jr. and Jason MacFetters of The Young Firm in New Orleans. Jury trial is requested.
U.S. District Judge Eldon E. Fallon is assigned to the case.
