A construction firm that built and then restored the Louisiana State University Health Sciences Center in New Orleans is claiming that LSU breached a contract to restore its building on Tulane Avenue after Hurricane Katrina.
Gulf South Commercial Construction LLC (GSCC) is suing The Foundation for the L.S.U. Health Sciences Center and an unnamed insurer. New Orleans attorneys Brian Glorioso, Richard Tonry II, Raymond Brinson, Jeffery Waltz, and Kristine Sims filed the suit Jan. 6.
The suit claims that LSU hired GSCC from 2003 to 2004 to gut and remodel LSU's building, then again from 2005 to 2010 to repair damages from Hurricane Katrina. The suit also claims that LSU sought and applied for grants through the Federal Emergency Management Agency (FEMA).
GSCC claims that it performed a number of construction products, including submitting bid proposals, obtaining city and state permits, and coordinating with FEMA. The plaintiff also claims that, "During the course of providing these construction management services, [LSU] never informed GSCC that its role as construction manager was ever in question."
The suit claims that on March 2, 2010, LSU "breached its agreement with GSCC and terminated GSCC's involvement with the Tulane Avenue Property project." The suit seeks damages for breach of contract, detrimental release, negligent misrepresentation and intentional misrepresentation, among other charges.
