Construction workers sue New Orleans company over unpaid wages

Several construction workers are suing a New Orleans company for allegedly failing to pay more than $12,000 in wages.

Jose Castro, Wuilin Ayestas, Wilson Lagos, Marlon Lira, Leoncio Reyes, Fredy Barahona, Jose Lira and Jose Daniel Reyes filed suit against Southern Stucco Inc. on April 21 in federal court in New Orleans.

The men claim they worked as employees of Southern Stucco on the construction project on Ridgelake Drive during August and September 2010.

The men state that they did not receive any pay for their time worked.

The defendant is accused of violating the Fair Labor Standards Act, violating the Louisiana Wage Payment statute and breach of contract.

According to the lawsuit, the defendant states the men worked for the subcontractor JB Applicators.

The lawsuit is seeking damages for wages owed, liquidated damages, attorney fees, costs and interest.

The plaintiff is represented by Michael T. Tusa, Jr. of Sutton & Alker in Mandeville.

U.S. District Judge Helen G. Berrigan is assigned to the case.
