An employee of Cytec's Fortier facility, suffering from hearing loss, has filed a lawsuit claiming he was exposed to unreasonably loud and damaging noise on a regular and continuous basis for approximately 39 years.
Edward Joseph Daigle filed suit against Cytec Industries Inc. and XYZ Insurance Co. on March 18 in Jefferson Parish District Court. The defendant removed the case to federal court in New Orleans on April 13.
Daigle worked at the Fortier facility from August 1971 to April 2010 and states he was exposed to loud and dangerous noise which resulted in gradual hearing loss.
The defendant is accused of negligence for failing to provide proper supervision, safety instruction and warnings concerning hazardous conditions in the workplace and failing to provide a safe place to work.

t is also accused of failing to follow the requirements of applicable state and federal regulations regarding workplace noise exposures, including the Walsh-Healey Act.
Daigle states that his employer intentionally withheld or concealed knowledge gained from annual physical examinations that Daigle was suffering from noise-induced hearing loss.
Daigle is seeking damages for physical pain and mental pain and suffering, disability, medical bills, loss of enjoyment of life, interest and court costs.
The plaintiff is represented by Pearl River attorney Mathieu E. Daigle.
U.S. District Judge Sarah S. Vance is assigned to the case.
