Customer sues Wal-Mart after tripping over 'falling price' sign

A Wal-Mart customer claims he slipped and fell over a "falling price" sign as he was exiting a store on Berman Highway in Orleans Parish.

Daniel Jones and Janet Jones filed suit against Wal-Mart Stores Inc. on April 6 in Orleans Parish District Court. The defendant removed the case to federal court in New Orleans on May 11.

The defendant is accused of failing to properly maintain the premises, failing to warn their customer of known dangerous conditions, failing to adequately inspect property and premises, placing their customers in a dangerous situation by lack of inspection, repair or maintenance and inadequate installation of signs and prices.

Daniel Jones is seeking damages for physical pain, suffering, disability, mental anguish, lost wages, loss of earning capacity, medical expenses, interest and court costs. Janet Jones is seeking damages for mental anguish, suffering and loss of consortium.

The plaintiffs are represented by New Orleans attorneys William E. Mura, Jr. and Warren A. Forstall, Jr.

U.S. District Judge Kurt D. Engelhardt is assigned to the case.
