Seaman sues employer after accident causes disabling injury

After suffering permanent and disabling injuries to his spine, seaman Erneto L. Posana filed suit against Kilgore Marine and Kilgore Marine Services Inc. on May 23 in federal court in New Orleans.

According to the lawsuit, an accident occurred on Dec. 28, 2010, while Erneto Posana was working aboard the M/V K-Marine XXII in the Gulf of Mexico. Posana claims that the accident was a direct result of the negligence of the defendants in failing to properly supervise, direct and control the operation being conducted at the time of his injury, failing to provide adequate assistance and for failing to provide a safe place to work.

The plaintiff is seeking damages for physical, emotional and mental pain and anguish and distress, permanent disability, loss of physical and mental function, loss of wages, loss of wage earning capacity, medical expenses, maintenance and cure, punitive damages, attorney's fees, interest and court costs.

Posana is represented by John G. Munoz of Garner & Munoz in New Orleans.

U.S. District Judge Eldon E. Fallon is assigned to the case.
