Electrician sues employer seeking overtime wages

A LaFourche Parish electrician has filed a lawsuit against his employer for allegedly failing to pay overtime wages.

Scotty J. Trosclair filed suit against Offshore Marine Contractors Inc. on Aug. 22 in LaFourche Parish District Court. The defendant removed the case on Sept. 16 to the federal court in New Orleans.

Trosclair worked for the defendant from Sept. 15, 2009 until 2011 as an electrician classified as a "non-exempt" employee under the terms and provisions of the Federal Labor Standards Act.

He states he was not paid for time and one-half of his normal hourly wage for his hours worked in excess of 40 hours per week. He was paid at a set salary rate.

The plaintiff is seeking general damages for inadequate compensation, inconvenience, loss of earnings, other damages, interest, attorney's fees and court costs.

Trosclair is represented by Houma attorney Howard Lucas Marcello.

U.S. District Judge Martin L. C. Feldman is assigned to the case.
