Shopper files lawsuit accusing store of not warning of liquid on floor

An Orleans Parish resident is suing Wal-Mart for not quickly cleaning liquid off the store floor, which caused her to slip and fall.

Ann Brown filed suit against Wal-Mart Stores Inc. and XYZ Insurance Co. on Oct. 11 in federal court in New Orleans.

The alleged incident occurred on Dec. 16, 2010 as Brown was shopping at the Wal-Mart located in Chalmette. She states she slipped and fell on a liquid substance on the store floor.

Wal-Mart is accused of negligence for failing to clean the liquid off the store floor in a timely manner, failure to maintain a safe environment for its patrons, failing to warn patrons of the liquid on the floor, failing to monitor the store, failing to do what should have been done and failing to see what should have been seen in order to have avoided the occurrence of the accident made the basis of these proceedings.

The plaintiff is seeking damages for pain and suffering, bodily disability, loss of use/function, impairment of psychological functioning, loss of enjoyment of life, medical expenses, lost wages, disability, destruction of earning capacity, disability from engaging in recreation, interest and court costs.

Brown is represented by Rodney Kelp Littlefield of Martin E. Regan & Associates, P.L.C. in New Orleans. A jury trial is requested.

U.S. District Judge Nannette Jolivette Brown is assigned to the case.
