An independent contractor has filed a $1.5 million lawsuit against a Covington supermarket after he was injured by a malfunctioning piece of equipment.
Alan Dampier filed suit against Rouses Enterprises on Dec. 14 in federal court in New Orleans.
The accident occurred on Dec. 26, 2010, as Dampier was working as an independent contractor employed to perform specialized work at a Rouses supermarket located in Covington. Dampier states that he suffered serious and permanent injuries when a baler malfunctioned.
He argues that the defendant should have known of the dangerous condition of the baler, yet failed to replace it, and failed to warn others of its danger.
The plaintiff is seeking damages for medical expenses, pain and suffering, mental anguish, loss of wages, loss of earning capacity, disability, disfigurement, loss of physical function, loss of ability to enjoy life, loss of ability to pursue happiness, embarrassment, interest and court costs.
Dampier is represented by John H. Denenea, Jr. and Brian G. Shearman of Sherman-Denenea in New Orleans. A jury trial is requested.
