Construction company sued by property owner claiming major damages during home elevation

Richard B. Levin

An Orleans Parish man is suing a contractor for allegedly causing major damage to his home when it was being elevated.

Kike Dilbert filed suit in Orleans Parish Civil District Court on Dec. 12 against Leeverne Fisher and Fisher and Fisher Home Improvements.

According to the filing, the plaintiff entered into an agreement with the defendant to elevate his house four feet for $8,000. The suit claims Fisher sent out only one man who had never done a house elevation before instead of the four to six normally expected to do such a job. Dilbert alleges the man significantly damaged his house after working on the job over a three- to four-day period.

An expert report solicited by Dilbert says the home is out of compliance with current building codes due to the issues caused by Fisher's employee and included findings such as the sheetrock was damaged, the brick veneer was improperly supported and severe cracking and distortion of the floors was sustained. Bids solicited to correct the problems came in between $42,000 and 65,000, the suit says.

The plaintiff is seeking damages in order to repair the home. Dilbert asserts he attempted to address the issue with owner Leeverne Fisher, but was rebuffed.

The case was filed on behalf of Dilbert by Richard B. Levin, of Metairie-based Levin Law Offices.

The case has been assigned to Division H Judge Michael G. Bagneris.
