Neighborhood association files suit seeking to disallow school improvements due to traffic

An Uptown New Orleans neighborhood association, along with numerous area residents, filed suit against the city for granting a zoning permit so a school within their association boundaries could construct an addition.

The Upper Audubon Association filed suit in the Orleans Parish Civil District Court against the Board of Zoning Adjustments for the City of New Orleans on Dec. 16.

The plaintiff claims the construction of an addition to a charter school operated by French and Montessori Education, Inc. would affect traffic flow and result in increased traffic congestion, danger to pedestrians going to and from the school and exacerbate long-standing illegal parking issues connected to the school.

Members of the association say they expressed concerns at a meeting with the Orleans Parish School Board, but those concerns were not addressed in further meetings as promised by the school and school board.

The plaintiffs seek to reverse the zoning board's decision.

The Upper Audubon Association is being represented by attorney Charles F. Seemann, of New Orleans-based Proskauer Rose, and New Orleans-based attorney Richard E. McCormack.

The case has been assigned to Division D Judge Lloyd J. Medley.
